Sourcing RC and Battery-Powered Toys: Radio, Battery and Shipping Rules

Sourcing remote-control and battery-powered toys adds three things to a normal toy order: radio equipment approval for the transmitter, UN38.3 testing plus a safety data sheet for the lithium cells, and a battery classification that decides whether the goods can fly at all. Get those three at quotation stage and the rest of the order behaves like any other toy purchase.

The three documents that are specific to this category

Radio equipment approval

Anything that transmits needs approval for the destination market — RED in the EU, FCC in the US. The trap here is specific and common: a factory may hold valid approval for the transmitter module it buys in, but not for the finished model. Ask which legal entity the certificate names and which item numbers it covers. A module certificate is not automatically a product certificate.

UN38.3 for the cells

Lithium cells and batteries must pass UN38.3 transport testing. The report belongs to the cell manufacturer, so the factory is passing on a document from its component supplier. Check that the cell described in the report is the cell actually fitted — a change of battery supplier mid-production invalidates the paperwork you were given.

Battery safety data sheet

Your freight forwarder will ask for an SDS (sometimes still called MSDS) before accepting the booking. This is routinely the document that holds up a shipment, because nobody requests it until the goods are already packed. Ask for it with the quotation.

How the battery ships decides how the goods ship

There are three configurations, and they are treated differently in transport:

  • Cells installed in the equipment — generally the most straightforward configuration.
  • Cells packed with the equipment — in the same box but not fitted; different handling requirements.
  • Cells shipped separately — the most restricted, and by air often not viable at all.

Decide this early, because it interacts with packaging design and with your replenishment plan. Sea freight is the default for RC in volume regardless, but if you ever expect to air-freight an urgent top-up, the configuration you chose at first order will determine whether that is possible.

One more consideration for the EU: batteries carry their own producer-responsibility and marking obligations separate from toy safety. Confirm who is registering as producer in your market before goods arrive.

The general toy baseline still applies

Radio and battery documents sit on top of normal toy compliance, not instead of it. For an RC toy you still need EN 71 and a CE Declaration of Conformity for the EU, ASTM F963-23 with a CPC for the US, plus a named responsible person under GPSR. Buyers occasionally assume the RED certificate covers everything; it does not — it covers the radio.

Function testing also matters more here than in most categories. Specify at inspection stage how many units are to be powered on, what a pass looks like, how long the model should run on a full charge, and that the transmitter pairs and has usable range. “Functions normally” is not a specification an inspector can apply.

Where certification is the long pole, it is the lab and the paperwork that set your launch date, not the production line. Build that into the plan for any model that has not previously sold into your market.

Frequently asked questions

Does every RC toy need RED certification for the EU?

Anything containing a radio transmitter falls under the Radio Equipment Directive. What varies is whether existing certification already covers the finished product you are buying, or whether your model needs its own assessment. Ask the supplier to show the certificate and confirm it names the item numbers on your order.

Can I ship RC toys by air?

Sometimes, and it depends on the battery configuration, the cell capacity and the carrier’s own policy. Confirm air viability with your forwarder against the specific SDS and UN38.3 report rather than assuming it.

What if the factory changes the battery supplier?

Your UN38.3 report and SDS no longer describe what is in the box. Make it an explicit condition that any component change is notified in advance, and re-collect the documents when it happens. This is one of the most common causes of a shipment being stopped at booking.

Are drones with cameras harder to import?

They carry more obligations than a basic RC car — radio approval, battery documentation, and in some markets additional rules around the camera and data. If your first order into this category has a tight deadline, a non-camera model is a materially simpler starting point.

Who is responsible if a battery fails in the market?

As importer you are the responsible economic operator in your market, whatever the factory agreement says between you. That is exactly why the entity names on the certificates should match the entity you are contracting with, and why the documentation checks belong before the deposit rather than after arrival.
